Many Californians decide to handle their divorce without hiring an attorney. That is a common and legitimate choice, especially when spouses agree on most issues. But “without an attorney” does not have to mean “completely on your own.” A Registered Legal Document Assistant (LDA) offers a middle option for people who want to represent themselves without preparing every document alone.
What a Do-It-Yourself Divorce Really Involves
A California divorce is not a single form. Even an uncontested case usually involves a series of documents prepared over several months, including petitions, responses, financial disclosures, agreements and the final judgment. Each document has to be complete, consistent with the others and acceptable to the county court where the case is filed.
People who prepare everything themselves often underestimate:
- The time involved. Researching requirements, completing documents and correcting mistakes can take many evenings and weekends.
- The level of detail. Names, dates, case numbers, property and debt information and support figures need to match across many pages.
- County differences. Each Superior Court can have its own local requirements and review practices.
- The judgment stage. The final judgment package is where many self-prepared cases get stuck in repeated rejections.
What a Legal Document Assistant Does
A Legal Document Assistant is a professional registered and bonded with a California county to prepare legal documents for self-represented people. An LDA prepares documents based on the information and specific direction you provide, so you stay in control of your case while someone experienced handles the paperwork.
An LDA does not give legal advice, represent you in court, or tell you which legal strategy to choose. You remain the decision-maker, and you can consult an attorney at any point if you have legal questions.
DIY, LDA or Attorney: A Quick Comparison
| Do It Yourself | Legal Document Assistant | Attorney | |
|---|---|---|---|
| Who prepares documents | You | LDA, at your direction | Attorney and staff |
| Legal advice | No | No | Yes |
| Court representation | No | No | Yes |
| Typical cost | Court fees only | Flat fee for document preparation | Usually hourly, often with a retainer |
| Your time investment | High | Lower | Lowest |
Who an LDA Is a Good Fit For
Working with a Legal Document Assistant is often a good fit if you:
- Want to represent yourself but do not want to prepare every document alone
- Have reached, or expect to reach, an agreement with your spouse on most issues
- Want a predictable, flat fee instead of hourly billing
- Have already tried on your own and had documents rejected by the court
When You Should Consult an Attorney
Some situations call for a licensed attorney rather than document preparation alone. These can include contested custody disputes, complex property or business interests, concerns about domestic violence or safety, or any situation where you need advice about your legal rights. An LDA cannot advise you on these questions.
