QDRO Documents
What Is a Qualified Domestic Relations Order?
A Qualified Domestic Relations Order, commonly called a QDRO, is a domestic relations order that may recognize or create an alternate payee’s right to receive some or all of a participant’s benefits under certain employer-sponsored retirement plans.
A QDRO may be needed when retirement benefits are divided as part of a divorce, legal separation, child support matter, or another family court proceeding.
The retirement plan administrator reviews the order and determines whether it meets the plan’s requirements to qualify as a QDRO. A court-filed order is not automatically guaranteed to be accepted by the retirement plan.

Why LegalDoc-Prep
Why QDRO Documents Require Careful Preparation
Retirement plans do not necessarily use the same forms, procedures, or model language. A document prepared for one plan may not be appropriate for another plan.
Depending on the plan and the court order, the QDRO may need to clearly identify:
- The retirement plan participant
- The alternate payee receiving benefits
- The exact name of the retirement plan
- The amount, percentage, or calculation method
- The period of time or payments covered
- Survivor benefit provisions, when applicable
- Other information required by the plan
LegalDoc-Prep prepares requested documents using the information and instructions supplied by the client. We do not decide how benefits should be divided or select legal provisions for the client.
Information Needed
Information That May Be Needed
Before QDRO document preparation in California begins, you may need information from your divorce judgment, settlement agreement, retirement plan, or plan administrator.
- Names and addresses of the participant and alternate payee
- Divorce or family court case number
- County and court information
- A copy of the judgment or settlement agreement
- The exact legal name of the retirement plan
- Plan statements or benefit information
- The plan’s written QDRO procedures
- Model language supplied by the plan, if available
- Specific benefit-division instructions
- Documents requested by the court or plan administrator
Plan Administrator Review
Retirement plans generally have written procedures for reviewing domestic relations orders. The plan administrator—not LegalDoc-Prep—determines whether an order qualifies as a QDRO under the plan.
Some plan administrators may review a proposed order before it is submitted to the court. This is sometimes called preapproval or prequalification. Procedures vary by plan, and preapproval does not guarantee final acceptance.
If a plan administrator requests corrections, LegalDoc-Prep may assist with revisions based on the written response and the client’s instructions.
Pension Plan Joinder
In some California family court cases, additional documents may be needed to join a pension or retirement plan to the court proceeding. Whether joinder is required depends on the plan, the case, and the applicable procedure.
LegalDoc-Prep can prepare requested joinder documents using information supplied by the client. We cannot determine whether joinder is legally required in a particular case. Questions about legal requirements should be directed to an attorney.

Frequently Asked Questions
Common Questions About QDRO Documents
Can LegalDoc-Prep prepare my QDRO documents?
Yes. LegalDoc-Prep can prepare requested QDRO documents using the information, court orders, plan requirements, and instructions provided by the client.
How much does it cost to prepare a QDRO?
We charge a flat fee for QDRO preparation, quoted during your free evaluation once we know the retirement plan and the order needed. Once quoted, your fee does not increase.
Does LegalDoc-Prep decide how retirement benefits will be divided?
No. We do not decide percentages, payment amounts, survivor benefits, valuation dates, or other legal and financial terms. These instructions must come from the client’s judgment, agreement, attorney, or another authorized source.
Who decides whether the order qualifies as a QDRO?
The retirement plan administrator reviews the order and determines whether it satisfies the plan’s qualification requirements.
Can the same QDRO be used for every retirement plan?
No. Retirement plans may have different requirements and procedures. Separate orders may also be necessary when more than one retirement plan is involved.
Can a QDRO be prepared after the divorce is finalized?
Documents may sometimes be prepared after entry of the divorce judgment. Questions about timing, deadlines, or legal rights should be discussed with an attorney or the retirement plan administrator.
